Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and INBOXTONIC ("Company," "we," "us," or "our") concerning your access to and use of the INBOXTONIC Chrome extension and website (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility
1.1 Age Requirements

You must be at least 13 years old (or 16 years old if you are located in the European Union) to use the Service. If you are under 18, you represent that you have obtained consent from your parent or legal guardian to use the Service.

By using the Service, you represent and warrant that:

  • You meet the age requirements stated above.
  • You have the legal capacity to enter into these Terms.
  • You are not prohibited from using the Service under applicable laws.
1.2 Account Requirements

To use certain features of the Service, you must:

  • Have a valid Google account (for authentication via Google OAuth).
  • Have access to Google Gmail.
  • Have a compatible browser (Google Chrome, Microsoft Edge, Brave, or other Chromium-based browsers).
2. Description of Service
2.1 What INBOXTONIC Does

INBOXTONIC is an AI-powered email assistant that helps you:

  • Generate email replies and compositions using artificial intelligence.
  • Choose from multiple AI models and tone options.
  • Personalize email generation based on your writing style (optional).
  • Manage your email workflow more efficiently.
2.2 Service Features

The Service includes:

  • AI Email Generation: Generate email content using advanced AI models.
  • Multiple Tones: Choose from 3-20 professional tones depending on your plan.
  • Smart Route: Automatic selection of the best AI model and tone.
  • Writing Style Learning: Optional personalization based on your writing patterns.
  • Multi-Model Support: Access to multiple AI providers (Gemini, Grok, Claude, GPT, DeepSeek).
2.3 Service Limitations

The Service:

  • Does NOT read, access, or store your existing email content.
  • Does NOT send emails on your behalf (you must review and send manually).
  • Does NOT provide legal, financial, medical, or professional advice.
  • Requires an active internet connection to function.
  • May occasionally experience downtime or technical issues.
3. Account Registration and Security
3.1 Account Creation

To use the Service, you must:

  • Authenticate using your Google account via Google OAuth.
  • Accept these Terms and our Privacy Policy.
  • Provide accurate and complete information.
3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.
  • Logging out of your account when using shared or public devices.

We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Termination by User

You may delete your account at any time by:

  • Going to Settings → Account → Delete Account in the extension.
  • Contacting us at support@inboxtonic.com.

Upon account deletion:

  • Your access to the Service will be immediately terminated.
  • Your data will be deleted in accordance with our Privacy Policy.
  • Any unused credits or subscription time will be forfeited (no refunds for partial months).
4. Subscription Plans and Pricing
4.1 Available Plans

INBOXTONIC offers three subscription tiers:

Free Plan:

  • 20 AI generations per month.
  • 3 essential tones.
  • Smart Route feature.
  • Basic context understanding.

Plus Plan ($4.99/month):

  • 200 AI generations per month.
  • 8 professional tones.
  • Advanced context analysis.
  • Writing style learning.
  • Priority email support.

Pro Plan ($9.99/month):

  • 500 AI generations per month.
  • 20 specialized tones (complete library).
  • All Plus features.
  • Early access to new features.
  • Priority support with dedicated account manager.
4.2 Billing and Payment
  • Payment Processing: All payments are processed securely through Stripe.
  • Billing Cycle: Subscriptions are billed monthly on the date you upgraded.
  • Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Payment Methods: We accept major credit cards and other payment methods supported by Stripe.
  • Failed Payments: If payment fails, we will attempt to charge your payment method up to 3 times. After 3 failed attempts, your subscription will be cancelled and you will be downgraded to the Free plan.
4.3 Price Changes

We reserve the right to modify our pricing at any time. Price changes will:

  • Not affect your current billing cycle.
  • Be communicated at least 30 days in advance.
  • Take effect on your next renewal date.

You may cancel your subscription before the price change takes effect to avoid the new pricing.

4.4 Taxes

Prices do not include applicable taxes, duties, or fees. You are responsible for paying any taxes associated with your subscription.

5. Cancellation and Refunds
5.1 Cancellation Policy

You may cancel your subscription at any time by:

  • Using the "Manage Billing" link in Settings.
  • Contacting us at support@inboxtonic.com.

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.

5.2 Refund Policy

We offer a 30-day money-back guarantee for first-time subscribers to Plus or Pro plans.

Eligibility for Refund:

  • Request must be made within 30 days of your initial subscription.
  • Only applies to your first payment (not renewals).
  • Account must not have been used for fraudulent or abusive purposes.

How to Request a Refund:

  • Email support@inboxtonic.com with "Refund Request" in the subject line.
  • Include your account email and reason for refund (optional).
  • Refunds are processed within 5-7 business days.

No Refunds For:

  • Partial months of service.
  • Subscription renewals after the first month.
  • Downgrade from Pro to Plus or Plus to Free.
  • Account termination due to Terms violation.
5.3 Free Trial Policy

We do not currently offer free trials for paid plans. Our Free plan serves as a risk-free way to try the Service.

6. Usage Limits and Fair Use
6.1 Generation Limits

Your plan includes a monthly allocation of AI generations:

  • Free: 20 generations per month.
  • Plus: 200 generations per month.
  • Pro: 500 generations per month.

Generation limits reset on the 1st of each month (or on your subscription renewal date).

Unused generations do not roll over to the next month.

6.2 Fair Use Policy

You agree to use the Service in a reasonable manner and not to:

  • Abuse or exploit the Service for commercial resale.
  • Use automated scripts or bots to generate excessive requests.
  • Share your account with others (each user must have their own account).
  • Use the Service to generate content that violates these Terms.

We reserve the right to suspend or terminate accounts that violate our Fair Use Policy.

6.3 Rate Limiting

To ensure service availability for all users, we may implement rate limiting:

  • Maximum 10 generations per minute.
  • Maximum 50 generations per hour.

Excessive usage may result in temporary account suspension.

7. Acceptable Use Policy
7.1 Prohibited Uses

You agree NOT to use the Service to:

Illegal Activities:

  • Violate any applicable laws, regulations, or third-party rights.
  • Engage in fraudulent, deceptive, or misleading practices.
  • Facilitate illegal activities or transactions.

Harmful Content:

  • Generate content that is defamatory, libelous, or harassing.
  • Create content that promotes violence, hate speech, or discrimination.
  • Produce sexually explicit or pornographic content involving minors.
  • Generate content that infringes on intellectual property rights.

Abusive Behavior:

  • Spam, phish, or send unsolicited commercial messages.
  • Impersonate any person or entity.
  • Distribute malware, viruses, or other harmful code.
  • Attempt to gain unauthorized access to our systems or other users' accounts.

Service Abuse:

  • Reverse engineer, decompile, or disassemble the Service.
  • Remove, circumvent, or disable any security features or usage limits.
  • Scrape, crawl, or spider any portion of the Service.
  • Interfere with or disrupt the Service or servers.
7.2 Content Responsibility

You are solely responsible for:

  • The content of your email instructions and context.
  • Any emails generated by the Service based on your input.
  • Reviewing AI-generated content before sending.

We do not review, monitor, or pre-approve user-generated content. We are not responsible for the accuracy, appropriateness, or legality of content generated by the AI based on your instructions.

7.3 Reporting Violations

If you become aware of any violation of these Terms, please report it to abuse@inboxtonic.com.

8. AI-Generated Content
8.1 Nature of AI Technology

You acknowledge and agree that:

  • AI-generated content may not always be accurate, appropriate, or reliable.
  • AI models can produce incorrect, biased, or nonsensical output.
  • You must review and verify all AI-generated content before using it.
  • We do not guarantee the quality, accuracy, or suitability of AI-generated content.
8.2 No Warranties on AI Output

THE SERVICE GENERATES CONTENT USING THIRD-PARTY AI MODELS. WE MAKE NO WARRANTIES REGARDING:

  • Accuracy of information in AI-generated emails.
  • Appropriateness of tone or style for your intended purpose.
  • Compliance with industry-specific regulations (legal, medical, financial).
  • Freedom from errors, biases, or offensive content.
8.3 User Responsibility

You agree to:

  • Review all AI-generated content before sending.
  • Verify accuracy of factual claims or information.
  • Ensure compliance with applicable laws and regulations.
  • Not rely on AI-generated content as professional advice.
9. Intellectual Property Rights
9.1 Our Intellectual Property

The Service, including its software, code, design, trademarks, logos, and content, is owned by INBOXTONIC and protected by intellectual property laws.

You may NOT:

  • Copy, modify, distribute, or create derivative works of the Service.
  • Use our trademarks, logos, or branding without written permission.
  • Reverse engineer or attempt to extract source code.
  • Remove or alter any copyright, trademark, or proprietary notices.
9.2 Your Intellectual Property

You retain ownership of:

  • Your email instructions and context.
  • Your writing style data (if you opt into personalization).
  • Any content you create using the Service.

License to Us: By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

  • Process your instructions to generate AI content.
  • Analyze your writing style (if you opt in).
  • Use anonymized, aggregated data to improve the Service.

This license terminates when you delete your account or remove your data.

9.3 AI-Generated Content Ownership

Ownership of AI-generated content is complex. While we do not claim ownership of AI-generated content produced for you, you acknowledge that:

  • Similar prompts may produce similar outputs for different users.
  • AI models are trained on vast datasets and may produce non-unique content.
  • Third-party AI providers may have their own terms regarding generated content.

10. Third-Party Services
10.1 Third-Party Integrations

The Service integrates with third-party services:

  • Google OAuth (for authentication).
  • Stripe (for payment processing).
  • AI Providers (OpenAI, Anthropic, Google, xAI, DeepSeek).

Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

10.2 Links to Third-Party Websites

The Service may contain links to third-party websites. We do not endorse or control these websites and are not responsible for their content, privacy practices, or terms of service.

11. Disclaimers and Limitations of Liability
11.1 Service "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose.
  • Warranties of non-infringement.
  • Warranties that the Service will be uninterrupted, error-free, or secure.
  • Warranties regarding the accuracy or reliability of AI-generated content.
11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INBOXTONIC SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, consequential, special, or punitive damages.
  • Loss of profits, revenue, data, or business opportunities.
  • Damages resulting from use or inability to use the Service.
  • Damages resulting from AI-generated content.
  • Damages resulting from unauthorized access to your account.

MAXIMUM LIABILITY: In no event shall our total liability exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless INBOXTONIC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you generate or send using the Service.
  • Your breach of any representation or warranty in these Terms.
13. Termination
13.1 Termination by You

You may terminate your account at any time as described in Section 3.3.

13.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without notice, if:

  • You violate these Terms.
  • You engage in fraudulent, illegal, or abusive behavior.
  • Your account is inactive for 12 consecutive months (Free plan only).
  • We are required to do so by law.
  • We discontinue the Service (with 30 days' notice).
13.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases.
  • Your data will be deleted in accordance with our Privacy Policy.
  • Sections that by their nature should survive (disclaimers, limitations of liability, indemnification) will survive termination.
14. Dispute Resolution
14.1 Governing Law

These Terms are governed by the laws of United Arab Emirates, without regard to conflict of law principles.

14.2 Arbitration Agreement

YOU AND INBOXTONIC AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION, NOT IN COURT, except for:

  • Small claims court disputes (below the jurisdictional limit).
  • Intellectual property disputes.
  • Disputes that cannot be arbitrated under applicable law.

Arbitration Rules:

  • Arbitration will be conducted under the rules of Dubai International Arbitration Centre (DIAC).
  • Arbitration will be held in Dubai, UAE.
  • Each party will bear its own costs and fees.
  • The arbitrator's decision is final and binding.

NO CLASS ACTIONS: You agree to bring claims only in your individual capacity and not as part of a class action or representative proceeding.

14.3 Opt-Out of Arbitration

You may opt out of this arbitration agreement by sending written notice to legal@inboxtonic.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

14.4 Informal Resolution

Before initiating arbitration, you agree to first contact us at legal@inboxtonic.com to attempt to resolve the dispute informally. We will respond within 30 days.

15. General Provisions
15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and INBOXTONIC regarding the Service and supersede all prior agreements.

15.2 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date.
  • Sending an email notification to your registered email address.
  • Displaying a prominent notice in the extension.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.4 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.5 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

15.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of government authorities, or technical failures.

15.7 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not use the Service in any country subject to a U.S. or international embargo or if you are on any government list of prohibited or restricted parties.

This extension is distributed through the Chrome Web Store and is subject to the Chrome Web Store Terms of Service.
